ECO Notice STU/1 Ref: STU/9/3/2 Issue 14 DEPARTMENT OF TRADE AND INDUSTRY EXPORT CONTROL ORGANISATION SUPPLEMENTARY NOTICE OF EXPORT LICENSING PROCEDURES 1. This Notice deals with the export licensing controls, designed to stop proliferation of weapons of mass destruction, as specified in Council Regulation (EC) 3381/94 ("the EC Regulation") (Article 4) and regulation 4(2)b and c of the Dual-Use and Related Goods (Export Control) Regulations 1996 (S.I. 1996/2721 ("the UK Regulations). It also deals with further controls not specified in these Regulations. Weapons of Mass Destruction 2. The combined effect of the EC Regulation and the UK Regulations is to prohibit in certain circumstances the export without a licence, the following goods: (a) any dual-use goods not listed in Annex 1 to Council Decision No 94/942/CFSP and Schedule 2 to the UK Regulations, and any goods other than dual-use goods, which (i) the exporter has been informed by his authorities are or may be intended, wholly or in part, to be used in connection with the development, production, handling, operation, maintenance, storage, detection, identification or dissemination of chemical, biological or nuclear weapons or the development, production, maintenance or storage of missiles capable of delivering such weapons; or (ii) the exporter knows are intended, wholly or in part, to be used in connection with one of the activities referred to in sub-paragraph (i) above; or (b) any goods which the exporter has grounds for suspecting might be used wholly or in part, in connection with an activity referred to in sub-paragraph (i) above unless he has made all reasonable enquiries as to their proposed use and satisfied himself that the goods will not be so used. A booklet on the "End-Use Control" is available from the DTI Enquiry Unit (see paragraph 7 below). Sanctions 3. United Nations trade sanctions are in place against Angola, Iraq and Libya. Sanctions vary widely in scope: they may prohibit all trade, eg restrictions upon exports, imports, financial transactions, communications, transportation. Or they may be more limited -- so-called selective sanctions, eg oil-related equipment. There are partial or total embargoes on the export of arms and military equipment to the following destinations, either arising from decisions taken by the Government or from agreements reached in international organisations of which the UK is a member: Argentina, Armenia, Azerbaijan, Bosnia and Herzegovina, China, Croatia, Iran, Liberia, Montenegro, Myanmar (Burma), Nigeria, Rwanda, Serbia, Somalia, Taiwan, the states of former Yugoslavia, and Zaire. Other controls on exports may be imposed.
